Probate is simply the legal process for the executors to obtain authority from the Court to deal with the estate of the person who has died, whereas Estate Administration refers to everything from securing the property, paying utilities, writing to banks and other asset holders, dealing with Income Tax and Capital Gains Tax and anything in between. Probate is a part of the overall Estate Administration process.


The Average Timeline - Obtaining Probate with a Will

In the UK, probate with a Will typically takes 6 to 12 months from start to finish. This estimate includes the following stages:

  1. Gathering Information (4 to 8 weeks): Executors must identify all assets and liabilities of the deceased, including bank accounts, property, investments, and debts. This step involves contacting institutions to get accurate valuations, which can take a few weeks depending on their responsiveness.

  2. Applying for Probate (3 to 6 weeks): Once the asset valuations are complete, the executor submits the Probate Application and, if applicable, pays any Inheritance Tax (IHT) owed. The probate registry usually processes applications within 3 to 6 weeks, though delays can occur during busy periods.

  3. Administering the Estate (6 to 12 months): After probate is granted, the executor can collect the deceased’s assets, settle any outstanding debts, and distribute the estate according to the Will. The timeline for this step depends on the complexity of the estate and any potential disputes.

While the process is straightforward in many cases, the following factors can affect how long probate takes:
