What is Estate Planning?

Tropical Leaf

Most people will not be familiar with the term Estate Planning and we expect you might be sat there scratching your head; conjuring up images of a vast Manor House in the countryside, surrounded by an extensive area of land which is owned by a wealthy family and wondering how this might have anything to do with you.

Well actually, Estate Planning is relevant to all of us, regardless of how much wealth we might possess. Estate Planning sits alongside making your Will and is a key part of putting your affairs in order for later in life.

If you want to plan for the management and distribution of your assets to your loved ones then look no further.

Specialist and Bespoke Estate Planning

Estate Planning involves a range of legal and financial strategies that are designed to help you to  achieve your goals while minimising taxes, preserving wealth and ensuring that your wishes are carried out.

Estate Planning can include drafting Wills, Trusts, Lasting Powers of Attorney, and other legal documents, tax and Estate Planning strategies, and helping you to navigate Probate, Trust and Estate administration, as well as providing guidance on charitable giving and other philanthropic activities.

Estate Planning may also include business succession planning, planning for vulnerable individuals, and asset protection planning. Estate Planning is unique to every person and we work closely with you to understand your individual needs and goals, and to develop customised plans that are tailored to your specific circumstances.

How We Can Help

Will

Writing

Simply put a Will is a legal document which provides instructions on what should happen to your assets (this includes your bank account, your home, your investments and even your personal belongings) when you die. Collectively referred to as your estate.

Asset

Protection

Will Trusts can be useful for a variety of reasons, such as providing for vulnerable beneficiaries who may not be able to manage their own finances, protecting assets from potential creditors or legal
disputes, and ensuring that assets are passed on in a tax-efficient manner.

Lasting Powers of Attorney

Lasting Powers of Attorney (LPA) are legal documents which allow you to appoint people you trust to act for you in circumstances where you may not be able to make decisions yourself. This could be as a result of an accident, injury or perhaps an illness like
Alzheimer’s or dementia.

Probate and Estate Administration

When someone dies, their next of kin or the person appointed within the Will is responsible for finalising their affairs. This includes things like closing bank accounts, selling their home, paying taxes, debts and other expenses, as well as applying to the Court for ‘Probate'. After which, they then have to pay the inheritance due to the beneficiaries named in the Will or who are entitled by law. This process is often referred to as Estate Administration or Probate.
